Respondent thereafter declared the 1st Respondent/Appellant as the winner of the election and he was duly returned as the Governor of the State. Dissatisfied with the result of the Election, the Petitioner/1st Respondent filed a petition before the Governorship Election Tribunal sitting at Gombe.
The Appellant as Petitioners before the Governorship Election Tribunal, Owerri had their petition dismissed for being abandoned by reason of non-valid application for issuance of pre-trial forms in line with paragraph 18 of the 1st Schedule to the Electoral Act, 2010 (as amended).
The Chairman of the Tribunal sitting alone consequently dismissed the petition upon an application by the Respondents, on the grounds that it was incompetence as it was filed outside the 21days period prescribed by law.
