SUMMARY OF FACTS
The Plaintiffs/Respondents sued the Defendants/Appellants at the High Court. In a separate suit, the Defendants/Appellants sued the Plaintiffs/Respondents at the same High Court. At the end of the proceedings, the trial Judge found for the plaintiffs and granted the plaintiffs all the reliefs sought in their claim. On the other hand, the defendant failed to prove ownership of the property so their claim failed in the suit filed. The trial court judgment was affirmed by the Court of Appeal. Hence the further appeal to the Supreme Court.
