SUMMARY OF FACTS

The Plaintiff now Respondent filed an action at the Adamawa State High Court against the Defendant now Appellant, claiming the sum of N5million being outstanding balance of a contract sum awarded to the Respondent by the Appellant, 20% interest on the outstanding balance of N5million and the cost of the action. The writ was placed under the undefended list but was later transferred to the general cause list when the Appellant filed a notice of intention to defend. At the conclusion of trial, the judge entered judgment in favour of the Respondent. Dissatisfied with the trial court’s decision, the Appellant has lodged the instant appeal.
