SUMMARY OF FACTS

The Plaintiff/Respondent instituted an undefended list action against the Defendant/Appellant at the Federal Capital Territory High Court claiming damages for breach of contract. The Defendant/Appellant filed a notice of intention to defend the suit. The trial Court dismissed the notice of intention to defend the suit and entered judgment for the Plaintiff/Respondent. Dissatisfied with the trial Court’s decision, the Defendant/Appellant appealed to the Court of Appeal where the appeal was dismissed thus culminating into a further appeal to the Supreme Court.
