SUMMARY OF FACTS
The appellant/ defendant was arraigned by the State in the High Court for armed robbery, he was consequently convicted and sentenced to death by hanging. Aggrieved by this, the appellant/ defendant appealed to the Court of Appeal where his appeal was dismissed. He consequently made a further appeal to the Supreme Court on grounds that the burden of proof had not been discharged and non-investigation of his alibi.
