The respondent/ plaintiff filled a suit in the the Highcourt of Ibadan, claiming a sum of money from the defendant, the matter was part heard and request for order of substituted service was made, but before then, the High court jurisdiction on the matter was recinded and only the Federal Revenue court had jurisdictions to handle such matters. The case was further listed before a court in the Federal Revenue Court, without any request by the parties for transfer.The appellant/ defendant raised an objection for lack of jurisdiction, and the court dismissed the objection.
HELD
The court held that the complaint of the appellant was fully justified and his appeal succeeded.
