The appellants instituted action against the respondents in a representative capacity contending that the 1st respondent was not competent to occupy the chieftaincy stool in dispute on the grounds, inter alia, that he was not a member of the ruling house.


HELD


The court held that in Chieftaincy disputes, a family as a Corporate entity may have a legal interest to protect entitling them to sue distinct from personal interest of individual members more so when they sue in representative capacity as in this case. ?
