Both accused persons were charged in the Jos High Court with the offence of Criminal conspiracy punishable under Section 97 of the Penal Code.

The Supreme Court held that the evidence of the accomplices as to how the money was paid to the appellants amply corroborated the testimony of the 1st and 2nd P/Ws who were clearly accomplices and were so found by the learned trial Judge.
