This is an appeal from a judgment of the Court of Appeal, Enugu Division given on 14 June, 1994. It upheld the decision of the High Court at Akwa in which the suit of the appellant (as plaintiff) was dismissed on 8 June 1992.   ?

ONUS ON PLAINTIFF TO PROVE EXCLUSIVE OWNERSHIP OF FAMILY LAND


It is settled law that where the land in dispute is accepted by the parties or found by the court to be originally a family land, the person who claims exclusive ownership thereof must fail unless he asserts by his pleadings and proves by evidence how that exclusive ownership devolves on him. BASIS OF JUDGMENT OF A COURT.
