The Appellant a soldier in the Nigerian Army was charged, convicted and sentence to 14 years imprisonment for rape, by the General Court Martial of the 81 Division Bonny Cantonment, Victoria Island, with the confirmation of the Chief of Army Staff. Dissatisfied with the judgment of the Court Martial he appealed to the Court of Appeal where his appeal was unanimously dismissed. He has further appealed to this Court.
