SUMMARY OF FACTS
The Appellants sued the Respondents in the Warri Area Customary Court for inter alia damages for trespass. Subsequently the Appellant’s newly introduced counsel applied to discontinue the matter on the ground that the court lacked the jurisdiction to entertain same. The court thereafter dismissed the case. An appeal to the High Court and Appeal Court was dismissed, hence this appeal.?

Appeal dismissed. The supreme court held that the court of appeal was right in upholding the Judgment of the trial court ?
