SUMMARY OF FACTS

The plaintiff claimed the deed of legal mortgage he executed to secure a loan from appellant was illegal and that he had paid the debt. The lower court dismissed the claim. The issue of illegality was not made an issue before the lower court.


HELD


The court held that the issue of illegality of the legal mortgage was not raised at the lower court, and that the plaintiff failed to discharge the burden on him of how he had settled the debt having admitted same prior to the institution of this action.
