SUMMARY OF FACTS

The plaintiff/respondent sued the defendants/appellants over a land in dispute, that they be declared entitled to the Right of Occupancy. The Trial Court gave judgment in favour of the defendants. Being dissatisfied, the plaintiff appealed. The Court of Appeal upheld the appeal and ordered a retrial. The defendants being dissatisfied have appealed to this Court.


HELD


The appeal succeeds. The judgment of the Court of Appeal dated 12th July, 1989 is hereby set aside. In its place is restored the judgment of the learned trial Judge dated 18th December, 1985. The appellant is awarded N300 as costs in the court below and N1,000.00 as costs in this court.
