SUMMARY OF FACTS
The court of appeal dismissed the appellant’s case on the ground that the action ought to have been commenced in accordance with the provisions of the Petition of Right Act because the cause of action arose before the 1979 constitution which abolished the said Act.
HELD
The court held that the petition of right act does not create a cause of action but a procedure for enforcing a cause of action and that the act having been abolished; the appellant’s action was competent.
