SUMMARY OF FACTS
The appellants sought an order of the court acquitting him of the offence of culpable homicide by reason of unsoundness of mind.
HELD
The Court held that statement of the appellant that he did not know what he did became relevant when taken along with the evidence of his detention at the psychiatric hospital for three months and made the defence of insanity available to the appellant under section 51 of the Penal Code Cap. 89 Laws of Northern Nigeria. The proceedings that took place in the Magistrates Court should have been placed before the trial Judge
