The respondents claimed title to the land in dispute on the basis of settlement and estoppels per rem judicatam. The trial court considered the claim on settlement and estoppel in dismissing the suit but stated that it was basing the decision on estopel alone.

The court held that the trial court did considered the respondents claim to the land on the basis of settlement from the record even though there is a statement to the effect that the decision was based on estoppels alone .
