SUMMARY OF FACTS
The Appellant/plaintiff sued the Respondent for repudiating their insurance policy via a letter written by the Respondent/Defendant. The High Court ruled in favour of the Defendant and the Plaintiff appealed.
HELD
The Supreme Court held that the learned trial Judge rightly came to the conclusion that he did that the letter (Exhibit 3) the insurers (the respondents) wrote to the plaintiff was not repudiating the policy of insurance, but merely stating that they did not accept that the loss was covered by the policy. The Court saw no merit in the appeal and dismissed it with 30 guineas costs to the respondents. Per I.Lewis, JSC.
