SUMMARY OF FACTS
The appellant together with five other persons were arraigned in an information preferred under Section 340 (2) (b) of the Criminal Procedure Law charging them with the murder of one Sunday Nnana. On appeal to the Supreme Court, the Appellant complained that the learned trial Judge misdirected himself when he said that in Exhibit 1 the witness mentioned the appellant at all.
HELD
The Supreme Court held that if the learned trial Judge had directed his mind to the very serious contradictions and inconsistencies of the witness, he would have reached a different conclusion on the evidence of this witness.
