Appeal against the disciplinary action taken by a tertiary institution against its student: to whom such lies.
HELD
The court held that the matter was within the domestic affairs of the university by virtue of the enabling statute and therefore, not justiciable in any court of law, the matter is not one within the ambit of fundamental human right and the failure of the respondent to exhaust all remedies available before rushing to the court did not strengthen his case any further, the appeal must therefore succeed.
