SUMMARY OF FACTS
The plaintiff sued the defendant over ownership of a parcel of land. He derived his title from Alashe family who has litigated upon the said land with the knowledge of Bashua family who alleged to have been owners of the land. Bashua family has acquiescence over the litigation by Alashe family.
HELD
The court held that the defendants is stopped from challenging the title of the plaintiff having stood by while the plaintiffs predecessor is litigating over the said land.
