SUMMARY OF FACTS
The Appellant and his wife were married for fifteen years after which his wife left him and got married to the deceased. Before the Appellant’s wife left him, she was already having an affair with the deceased and when the Appellant found out, he threatened the deceased that he would regret what he (the deceased) had done. On the fateful day, while the deceased was performing ablution outside his house, his wife heard a gunshot and rushed out only to see her husband on the floor in the pool of his blood and the Appellant running away with a gun in his hand. Subsequently the Appellant was arrested, charged to court, convicted and sentenced to death. It is on this conviction that the Appellant has appealed to this court.
