SUMMARY OF FACTS

By the customary law of Benin, upon the death of a father the eldest son takes over his estate as a trustee for all the deceased’s children pending the performance of the second (final) burial rites. Sometime in 1994, James Abudu bought a piece of land, now in dispute, from Omorodion Eguakun, the eldest son of Eguakun. The land belonged to late Eguakun and Omorodion as the eldest son, under Benin native law and custom, had certain rights.
