SUMMARY OF FACTS

The appeal is against the holding of the Court of Appeal which held that the relationship between the appellant and respondent was that of a banker-customer relationship. In holding that it was neither an Admiralty matter (as held by the trial court) nor a banker-customer relationship (as held by the court of Appeal), the court held that from the Statement of Claim filed, the matters is a Simple Contract which is within the ambit of the jurisdiction of the State High court.
