SUMMARY OF FACTS
The trial Court dismissed the petition of the petitioners (appellants) for a winding -up order under the supervision of the court in accordance with the provision of the Companies Decree No. 51 of 1968.
HELD
The Supreme Court held that it would be inequitable to grant the petition since the appellants would thus be enabled to obtain a stay of execution of the proceedings in respect of the objectors claim for breach of contract which is still pending in court.
