The appellant was convicted for robbery by the evidence of PW1 and PW2 who claimed they knew him before the 3 incidents of robberies. They however did not mention his name to the police or anyone until five days after the incidents.
HELD
The court held that the conviction of the appellant was unsafe in view of the fact that the witnesses did not mention him immediately and in the absence of any other evidence linking him with the robberies.
