SUMMARY OF FACTS

The Petitioner/Appellant instituted an action at the Governorship/Legislative Houses Election Tribunal Imo State, sitting at Owerri seeking for the cancellation of the election that returned the 1st Respondent as the winner on grounds of non-compliance with the provisions of the Electoral Act and a declaration that the Petitioner/Appellant was the winner of the said elections.  The tribunal struck out the petition of the Petitioner/Appellant on the grounds of non-joinder of the necessary parties, contradiction in the grounds of petition and averments therein coupled with the fact that the votes cast did not support a relief for declaring the Petitioner/Appellant the winner of the said elections. Dissatisfied with the tribunal’s ruling, the Petitioner/Appellant appealed to the Court of Appeal.
