The Respondent as plaintiff sued the Appellant at the Omoku High Court, Rivers State for a total sum of N3,120,000 for special and general damages. The Appellant via a motion challenged the jurisdiction of the court. In refusal of the application, an appeal was made to the Court of Appeal which made an order remitting the case back to the High Court, hence this appeal.
