The Appellant being dissatisfied with the decision of the High Court of the Federal Capital Territory, Abuja, lodged this appeal on grounds among others that the learned trial judge erred in law when he assumed jurisdiction to entertain the suit which as an abuse of the process of court because the subject matter is res judicata as a result of the final decision of the Federal High Court, Yenegoa and an appeal pending before the Court of Appeal in Port Harcourt.
