SUMMARY OF FACTS

The Plaintiff /Respondent at the Grade “A” Customary Court sued the Defendant /Appellant for a declaration of title to a piece or parcel of land called ESIJE situate at  Sabo Quarters University of Ife Road.The trial Court dismissed the claims of the  Plaintiff/Respondent after hearing both parties. Dissatisfied with the dismissal of his claims, the Plaintiff/Respondent appealed to the High Court at Ile- Ife where the judgment of the trial Court was reversed in favour of the Plaintiff/Respondent. Aggrieved, the Defendant/Appellant has appealed to this Court.
